Despite the winter transfer window having closed for several weeks now, FC Barcelona have still been trying to complete the operation for the sale of Vitor Roque to the Brazilian side Palmieras in the last few days.

Although optimism about the success of this move was increasing in recent days, the operation seemed to have broken down yesterday, as the Blaugranes did not get a favorable reply from La Liga when they made a query regarding this transfer.

The league authorities believed that breaking the loan agreement with Real Betis ahead of the time stipulated is not allowed outside of the transfer windows.

However, according to SPORT, Barcelona are still not giving up on this operation, and they are committed to ensuring this move takes place before the end of the transfer window in Brazil on 28th February, and for this purpose, they are ready to take their legal battle to FIFA and UEFA.

In fact, the Catalans have already submitted a double appeal to these footballing bodies based on the legal argument of “technical transfer”. To further strengthen their case, they have highlighted the precedence set by FIFA in a similar case in which one of the main protagonists of this operation, Palmeiras, was involved.

This precedence is known as the Pedro Lima case. In that instance, Palmeiras had used the “technical transfer” resource authorized by FIFA to break the loan of one of their players, Pedro Lima, from Norwich City, when the market was already closed in Brazil, before sending him on loan to the Croatian side NK Osijek, while the transfer window was open in Croatia. FIFA allowed this move to go ahead.

Now, Barcelona, Real Betis, Palmeiras, and Vitor Roque are involved in a similar case, as Barcelona want to break the loan with the Seville side while the transfer window is closed in Spain, and to transfer him to Brazil, where the transfer window is still open.

Thus, the Blaugranes have legal precedence on their side and can present a strong case to FIFA to ensure this move takes place. But time is of the essence, as the transfer market in Brazil is set to be closed on 28th February.
